In special situations, it is also permissible to provide help without consent to a person who is unwilling (e.g., unconscious) or who is limited to acting. Health services may be provided to a person with limited active legal capacity without consent if two conditions described in the law of obligations are met at the same time. In addition, a doctor has the right to decide whether a health service is in the patient`s interest, even if the patient`s legal representative does not agree with him. In the case of a person with limited active legal capacity, consent to the provision of health services must be obtained from his or her legal representative, i.e. his or her guardian. The legal representative is appointed by the court.
